TERMS AND CONDITIONS

A. PURPOSE

The following terms and conditions (hereinafter referred to as the “Terms & Conditions”) govern the use of www.cdm.ph and all its pages, content, other assets (hereinafter referred to as the “Service”).

The purpose of the Service’s Terms & Conditions is to clearly define the legal relationship between Certified Digital Marketer (CDM). (hereinafter referred to as “us”, “we”, or “our”) and users (hereinafter referred to as the “Learner”) who have entered into an agreement in accordance with the Terms & Conditions to use our Service.

The Learner should read the Terms & Conditions carefully. The use of this Service will constitute the Learner’s agreement to comply with the Terms & Conditions outlined on this page.

B. USE OF SERVICE

Learners are permitted to use the Service for their personal and non-commercial purposes from this Service provided that you do not modify any content without our consent. Learners shall refrain from using the website contents as below or in any manner that is beyond the scope of use permitted under this section. Learners shall bear all civil and criminal liability resulting from their unauthorized use of the contents. 

  • Republish material from the Service (including republication on another website);
  • Sell, rent, or otherwise sub-license material from the Service;
  • Show any material from the Service in public;
  • Reproduce, duplicate, copy or otherwise exploit material on our Service for a commercial purpose;
  • Edit or otherwise modify any material on the Website; or
  • Redistribute material from this Website, except for content specifically and expressly made available for redistribution

Learners shall not engage in any activity that interferes with the provision of the Service or access servers and network systems used for the Service without authorization.

Learners shall not engage in any of the following activities:

  • Provide false information or steal information from third parties
  • Activities that infringe our copyrights or other intellectual property rights
  • Activities that defame or disturb our business or third parties
  • Use the Service for commercial purposes without our consent
  • Impersonating us or intentionally spreading false information in connection with the Service
  • Other illegal or unlawful activities prohibited by relevant laws

Learners shall be responsible for managing their User IDs and passwords and shall be solely responsible for any and all damages caused by their intentional or negligent acts or omissions. Learners shall promptly notify us and follow our instructions, if any, in the event they become aware that their ID or password has been stolen or is being used by a third party.

Learners are permitted to purchase goods from the Service as a registered user subject to our payment conditions (see F. PAYMENTS) set below.

C. PROGRAM INCLUSIONS

Learners are entitled to the following inclusions:

Online Sessions
  • Live, online, subject matter expert-led lectures, exercises, and activities
  • Opportunity to consult with subject matter experts during sessions
Learning Management System
  • Set-up of and access to Learner’s Account
  • Access to presentation material by our subject matter experts
  • Access to supplementary learning materials (e.g. readings, case studies), if any
  • Digital certificate of Participation for attended sessions at the conclusion of the program

D. CERTIFICATION

Learners may only earn Certifications specific to the program they are enrolled in if:

  1. Learner enrolls in a Program that is eligible for Certification; and
  2. Learner selects the enrollment type that includes Certification.

Certifications are issued only after Learners complete the following:

  1. Attend all scheduled class sessions for eligible programs enrolled; and
  2. Pass the corresponding Certification Examination.
Examination

The Certification Examination is administered online through a module in the Learning Management System made available to Learners.

Coverage

The certification examination covers topics discussed in the program. A study guide is provided as a reference to the topics covered.

Guidelines
  1. The certification examination consists of 80 items ranging from declarative, procedural, and higher-order thinking questions.
  2. The passing grade is 75%.
  3. The certification module is made available to the Learner on the day following the conclusion of the eligible Program enrolled, and will be open for thirty (30) days. For enrollments under the Digital Acceleration Track, the certification module per eligible Program enrolled remains open for forty-five (45) days once made available to the Learner.
  4. The Learner may take the certification in their own time within this period.
  5. The certification examination is timed. The time limit is three (3) hours. Once three (3) hours have elapsed, the module will automatically conclude and provide the result.
Retakes
  1. Learners are given two (2) examination attempts. The second attempt may only be taken within the same thirty (30) day period.
  2. Retakes beyond the second attempt are subject to the Certified Digital Marketer’s approval, and to fees where applicable.
ISSUANCE & VALIDITY
  1. Certifications for successful candidates are released at least five (5) business days from the conclusion of the certification window (See D. CERTIFICATION > Guidelines > 3.)
  2. Certifications awarded to successful candidates are valid for two (2) years from date of issue.

E. RECERTIFICATION

Recertification is only available to select Learners who meet our current recertification criteria.

Recertifications are issued after Learners complete the following:

  1. Satisfy the current recertification eligibility criteria set by Certified Digital Marketer;
  2. Register (online or offline) and pay the recertification fee; and 
  3. Pass the corresponding recertification examination.
Examination

The Recertification Examination is administered online through a module in the Learning Management System made available to Learners called the CDP|CDM Learning Portal (www.lms.certified digitalmarketer.com).

Coverage

The Recertification examination covers topics that vary per recertification enrolled for. A study or exam guide is provided as reference to the topics covered. 

Guidelines
  1. The recertification examination consists of 80 items ranging from declarative, procedural, and higher order thinking questions.
  2. The topic coverage for each recertification exam is as published in the Exam Coverage in the Service.
  3. The passing grade rate is 75%.
  4. The recertification module is made available to the Learner on a pre-identified launch date and time according to the recertification batch. The module will be open for seventy-two (72) hours. 
  5. The Learner may take the recertification exam in their own time within this period. 
  6. The recertification examination is timed. The time limit is three (3) hours from the time the exam is started by the Learner. Once three (3) hours have elapsed, the module will automatically conclude and provide the result.
Rescheduling
  1. Learners who are unable to take the exam within the chosen recertification batch schedule must provide notice before the launch date and time of the said period. Upon receipt of notice, recertification will be automatically rescheduled to the next batch. If the Learner misses the next batch, the recertification enrollment will be automatically forfeited.
  2. Learners who are unable to take the exam within the chosen recertification batch schedule and who are not able to provide the required notice can request to reschedule by contacting our Student Support Team via email at community@elearningedge.net. The request is subject to the Certified Digital Marketer’s approval. If the request is approved, recertification will be automatically rescheduled to the next batch. If the Learner misses the next batch, the recertification enrollment will be automatically forfeited.
Retakes
  1. Learners are given one (1) recertification exam attempt within the given recertification exam period. (See E. RECERTIFICATION > Guidelines > 4.) A retake is optional if a Learner fails to meet the passing grade rate in their first exam attempt.
  2. Should the first attempt be unsuccessful, Learners are allowed to re-enroll for a recertification only at least six (6) months after their first exam attempt. 
  3. Learners can re-enroll for recertification for a maximum of one (1) instance only. Further attempts to submit re-enrollment after the first instance will be automatically declined. 
Issuance & Validity
  1. Certifications for successful candidates are released at least five (5) business days from the conclusion of the recertification window (See E. RECERTIFICATION > Guidelines > 4.)
  2. Certifications awarded to successful candidates are valid for two (2) years from date of issue.

F. PAYMENTS

The registration to a CDM learning experience is binding. As a registrant, Learners are personally responsible for the cost of the program.

Displayed rates are converted based on an estimated exchange rate. Final amounts may differ from Learners’ bank’s foreign currency conversion. Local 12% Value Added Tax (VAT) is applied in the amount total at checkout.

Late Payment

A penalty of 2.5% per month will be charged based on the total outstanding balance.

Payment Terms

100% would be directly paid and settled via PayMongo immediately. No account is required. No surcharges on the part of the payor. Your enrollment will be processed immediately once payment is reflected in our account.

Cards Accepted

PayMongo accepts all credit cards and debit cards (Mastercard and Visa) except American Express.

INSTALLMENTS via ATOME AND BILLEASE
Payment Terms

An account for Atome or BillEase (Platform) is required. The installment terms (repayment duration and interest rate) depends on the Platform’s current promotions and credit standing of the Learner.

G. ISSUANCE OF OFFICIAL RECEIPT

Official Receipts are registered in the Philippines and are issued out of our Philippine office. We are only able to issue an electronic image for the meantime. Original copy is available for delivery within the Philippines upon request.

H. VENUE & SCHEDULE CHANGES

Venues are subject to change for reasons including but not limited to class size, venue availability, safety & security, and other such circumstances that may directly or indirectly affect your learning experience.

Class schedules are guaranteed but are subject to cancellation and/or rescheduling for reasons including inclement weather, safety & security, and other unforeseen circumstances that make it unsafe and/or impracticable to hold classes.

Any such change will be communicated through notices sent to the email address and/or mobile number associated with the Learner’s account information. Please keep subscribed to our mailing list in order to receive such updates.

Should any such change render a Learner unable to attend the class with the resulting venue and/or schedule, they may do one of the following:

  • Reschedule to a later batch of the same program, if any; or
  • Transfer their learning credits to (1) another person; or (2) another program in the curriculum, as guided (see K. TRANSFER OF LEARNING CREDITS) in these Terms & Conditions.

I. CANCELLATION

If the cancellation is made at least seven (7) days before the scheduled first (1st) session, the Learner may:

  • Request for the refund of payments made up to 50% of enrollment fees; or
  • Request for the transfer of learning credits to another person, valid for three (3) months from the point of cancellation.

If the cancellation is made less than seven (7) days before the scheduled first (1st) session, the Learner is no longer eligible for a refund, but may:

  • Request for the transfer of learning credits to another person, valid for three (3) months from the point of cancellation.

J. RESCHEDULING

Learners may request to reschedule their enrollments subject to the following terms and conditions:

  • Reschedule requests must be made at least twenty-four (24) hours before the session being rescheduled. Requests made less than 24 hours from the start of the online class shall be subject for approval and/or applicable fees.
  • Students may only request to reschedule free of charge for a maximum of two (2) instances only. Succeeding reschedule requests will be subject to a reschedule fee of PHP 6,000.00 nett (PHP 5,385.00 + 12% VAT).
  • Regardless of the number of requests made, students may only reschedule up to (a) one (1) year from the original schedule, or (b) the curriculum retirement of the program enrolled, whichever comes first. Unconsumed learning credits beyond this period shall be considered forfeit and may no longer be cancelled, rescheduled, or transferred.

K TRANSFER OF LEARNING CREDITS

Learners may transfer their learning credits to (a) another person, or (b) another program in the curriculum. The request must be made at least seven (7) days before the scheduled first (1st) session.

Learning credits transferred to another person is only valid for three (3) months from the point of request.

Learning credits transferred to another program in the curriculum are subject to the following terms:

  • If the contract amount of the new program/s chosen exceeds the original contract amount, the learner must pay the difference.
  • If the contract value of the new program/s chosen is less than the original contract amount, the balance will not be refunded.
  • Inclusions will be based on the contract amount of the new program/s chosen. Discounts and privileges extended to the learner in the original contract are not guaranteed in the new contract.

L. INTELLECTUAL PROPERTY

Certified Digital Marketer owns all rights, title, and interest to its programs, sessions, modules, materials, and the content thereof including copyright, without material and territorial limitations.

We have the exclusive right in perpetuity to distribute, exhibit, and exploit the materials it provides in all jurisdictions and in any and all media, now existing or developed in the future.

Programs, sessions, modules, materials, and the content thereof, in whole or in part may not be recorded, modified, duplicated, or distributed for any purpose, personal or commercial, without the prior written consent of Certified Digital Marketer.

M. CHANGES TO AND TERMINATION OF THE SERVICE, ETC.

Certified Digital Marketer may change the contents of the Service if necessary. However, if such changes to the contents of the Service materially affect the rights and obligations of Learners, such changes shall be made after providing notice to Learners.

We may temporarily suspend the provision of the Service in the event its information and communications facilities and equipment require maintenance/repair or replacement, experience a breakdown or communications failure, or there exists significant operational reasons

We may, if necessary, conduct periodic inspections for the provision of the Service and temporarily suspend the provision of the Service during the periodic inspections.

We may suspend the provision of the Service for managerial reasons.

N. OUR RIGHTS, OBLIGATIONS, AND INDEMNITIES

Certified Digital Marketer reserves all rights to the Service.

We shall endeavor to provide the Service in a stable manner, but upon the occurrence of an act of God, war, or any other force majeure event, or if temporary suspension in accordance with the section on “M. CHANGES TO AND TERMINATION OF THE SERVICE, ETC.” becomes necessary, the Service may be suspended or discontinued, and in no event shall we be responsible or liable for such suspension or discontinuation of the Service.

O. GOVERNING LAW AND JURISDICTION

The Service is managed by Certified Digital Marketer, which is owned and currently being operated by ELearning Edge, Inc., located in Pasig City, Metro Manila, Philippines. You agree that any dispute related to these Terms & Conditions will be governed by the laws of the Republic of the Philippines, and the courts of the Republic of the Philippines shall have jurisdiction over any disputes arising from or related to the Terms & Conditions.
